It's the Black and Yellow Garden spider, as everyone else is saying! :) (hopefully XD)
And if I were to name it, I'd call it Bill.

Black and Yellow Garden Spider
Those thigns freak me out O.o
I'd name him Chucky. Because that thing scares me about as much as chucky did when I saw him for the first time (when I was 5 :P)

Well, everyone and their dog has answered, but it's still a black and yellow garden spider (or writing spider, or corn spider, or banana spider, or argiope aurantia). Someone I know walked into one's web once, and bounced off again. Fun times.

I choose to name it Fred/ina, the giant spider in Asher's backyard ;)
