TOS Clarification

Rules

explore_moneylighter.gif

This is an important announcement about a site rule clarification.

Linking to fundraising sites, donation sites, Paypal, etc. and/or otherwise asking or implying a request for monetary donations is not allowed on Aywas, as part of our Terms of Service.  We've noticed a number of these types of threads pop up recently.

In addition, offering things in exchange for "donations" is not allowed. If you are in a bind and in need of USD, we advise making a sales thread to sell your art for RL$* and follow Aywas sales rules (See: Sales and Breeding Rules in the TOS). Offering pet PSD colorings or other Aywas items for RL$ "donations" is technically selling those items for RL$ which is against the TOS (See: Sales and Breeding Rules and USD Sales and Cross-Site Trading in the TOS).

No fundraising in RL$ is allowed, unless it is on behalf of an official 501 (c)(3) charity where the money goes directly to the organization, or with prior arrangement with the Aywas site owner and Aywas administration.

If you have a post/thread that breaks these rules, we expect you to remove the links and rephrase the post (if need be), or remove the entire post immediately following this news post.

All of the above is covered in the Site Rules section of the TOS:
"- not solicit any asset - whether points, pets, items - from any user without offering proper pay (begging)"

We felt the need to clarify that the above TOS rule does not only apply to site assets, and does in fact also apply to IRL assets also.

* Note: RL$ = Real Life Currencies or anything that can be exchanged for Real Life Currencies such as gift cards, etc.

Thank you for your cooperation!

- Mauri

Not sure this is completely related, so I hope you don't mind the question, but what if we are not asking for currency, but for votes? My step-mother's college department has a good chance of winning $25k funding, and all they need are votes (have to be in the top 40 of 200). Would it be against the rules to post asking for help with this? (I feel I should mention that the voting is done through a facebook app) Thank you for any clarification on this.

I'm confused because I just checked my messages and I have one from an admin verifying, in mid-December, that I was okay to link to my gofundme because I was only asking for donations. So like... what?

There's a big difference between selling something and asking for handouts, or barely disguised donation requests with some type of token, (often vague) compensation. If you are exchanging defined services or art for money that doesn't include Aywas property, that's not a problem. "pay what you want" for art is fine. This applies to solicitation of donations only, regardless of platform, where the donations are not going to a registered charity. Votes are not a RL currency, so that's fine. Aywas cannot, does not, and will not even try to police what happens offsite.

I am little confused.
So we can't sell pet designs or colorations for real life money?
But we can as paintbrushes as an payment of colorings and designs?
and also no selling art for usd either?

I just wanna make sure I get it right. ^^;

Barajou: You can sell art totally unrelated to Aywas for USD. On the other hand, if you color/edit a site PSD (like a Melo), you can only take on-site currency/items for it - and that includes paintbrushes.

-Asks site players for donations to help support a woman and her new child.

-Asks site players not to ask for donations for their own support.

Seems legit.

Yeah, it seems kinda weird that it's okay for the site to do donation drives for certain players, but not for players to do donation drives for themselves/others. Why not just make a separate forum for it - and perhaps make it so that new topics in that forum do not show up on the "newest posts" area. That way, only people who WANT to see these threads, will.

Yeah, I saw a lot of begging for money in the forums. Thanks for addressing this!

The problem imo that people are outright begging. This isn't something the site should be dealing with as it's never been okay to do that and it bothers a lot of players to see it.

A lot of people might need help, but to allow cash donations and begging for money is just asking for trouble and for scammers to tell a good sob story and completely ruin the trust of the community.

Well I for one am glad of this announcement. I know I have seen some of the gofundme and was a little bothered after someone I new anonymously donated some money on someones only to see them later purchasing stuff from the event we recently had where you could use RL$ from other stuff, I was thinking I thought they needed help with money but obviously not if they were buying stuff from people on site with RL$. Then I was sick to my stomach about it but kept it to myself. Thanks Aywas!
