Site Update
Due to a miscommunication on my side, collecting and using the Bejeweled Carriage Exotic Egg started a day earlier than posted (Friday, December 6th at 12:00 AM AST instead of Saturday, December 7th at 12:00 AM AST). For 27 minutes, a handful of players were able to claim Bejeweled Carriage Exotic Eggs and traded them in for the remaining exotics. After being given a heads up about this, I shut down the script to claim exotics as well as the script to collect bonuses, and I transferred all claimed exotics claimed with those eggs to my account. After discussing this with the other members of staff, we have decided that we will be doing the following:
- Any players that claimed an exotic using a Bejeweled Carriage Exotic Egg that was collected after midnight on December 6th will have their egg returned to them.
- Any claimed exotic that was transferred to my account due to this issue will be purged and made available to be collected again on December 7th at midnight as planned.
- Any player that traded in their USD credit for any bonus tier that contained a Bejeweled Carriage Exotic Egg on December 6th, between 12:00 AM AST and 12:30 AM AST will have the opportunity to get their USD credit refunded to their account if they choose to do so and if the items still exist in their inventory. You can go here to see what bonus tiers are eligible for refunds, if you have any.
- We will re-enable the bonus tiers from now until Sunday, December 8th at 12:00 AM AST to give everyone an opportunity to collect any Bejeweled Carriage Exotic Eggs before Saturday, December 7th at 12:00 AM AST in an attempt to ensure that everyone has the same advantage.
- Any player that opened any items received in the eligible bonus tiers on December 6th between 12:00 AM AST and 12:30 AM AST and want their USD credit refunded, please contact me directly.
Any players that traded their USD credit for a bonus tier containing a Bejeweled Carriage Exotic Egg on December 6th, between 12:00 AM AST and 12:30 AM AST and opened any of the items within the tier and wants a refund of their USD credits should contact me directly if the tier they collected is ineligible for a refund, and they still want a refund. Please note that all items received through this tier, as well as any opened items, must still be available on the account to receive the refund. My family and I will be finished with our move sometime this weekend and afterwards, I will be around more to tackle such issues sooner so they don't turn into a hassle for everyone. I apologize to everyone I have inconvenienced with this.

Pre-shipping mess ups happen on sites many time, but for instant delivery mess ups you're in a whole new ball game. Anyone who bought anything during that time to specifically get said thing are 100% protected under law; those who had it laying around may not be. It's like a bait and switch. While comping those with what was already there, you're on some fine lines with those buying during that time.
Yes, digital is just like physical, but this would be like already buying said item. You can't force people to return what they had purchased. You could offer and ask, but at the end of the day it's up to the person holding that 121 dollar item they got for 21 if they feel like returning it.
As a user, even though I didn't purchase anything, I find this a very unfair move as you already goofed on the overall sale not once but twice in a row. Same year, not including late sales last year. Punishing users for something they were able to do, most of them unaware it shouldn't have been a thing, is rather wrong. I'd be down for giving them back the pets tomorrow night when they were meant to be allowed but just taking them away, personally, is rather infuriating. For all the users know you guys could have just swapped dates around by mistake, something that wouldn't have been picked up until the next day. The site messes up, breaks promises, and points fingers way too much for things that this to just be okay anymore. Frankly at this point I'd assume that things would run at least okay and not same issues/worse ones every year during major sales times which should 100% be top priority with things actually working.

This is so fair and welcome midway between the nuclear options people seem to have bees up their bonnets about. Despite people claiming unfairness retail just doesn't work that way, and staff has done a decent job at fixing their mistakes to make it fair on everyone.

Credit isn't a direct buy, plus the item the credit bought isn't being taken away, you can get the item back, or the credit to save for later, the credit and items are still able to be gotten no issue.
It isn't like people bought a pet and the pet was taken away, people stockpiled credit and bought an item with it. An Item that gives a chance of getting a pot pet. One that is not guaranteed to get said pet, and was advertised as not useable until a set time.
No one has lost a direct USD = Item or USD = Pet
I get what you're trying to say, but it's not a legal, law thing at all. If it was Aywas would risk just as much danger not having pets there on the announced time/day (Sat).

Nikki (#359) - sorry to butt in, and correct me if i'm wrong, but usd CREDIT does not equal usd- it's a bonus provided by the site and has no "real" usd value anyway besides the value perceived by users. the only "real" usd involved in these purchases is usd spent to purchase items in the usd shop, and as those items are delivered i don't think there's really a legal problem with the site putting the exotics back in the pot.

USD credit is a virtual currency, as when purchasing with USD, youve received the items on your receipt. Being as the pets were not directly purchased with USD, but as with a site currency that has been refunded, Aywas is in no legal danger.

"Legally" isn't the correct word for what you're trying to say because legally aywas owns all pets submitted to the site as covered by their TOS which we all agree to when making an account (and indicate agreement when continuing to play after they change it). And that's not just aywas, any pet site you play owns the pets wholly because they own the pet site and the intellectual property that goes along with it (which is how pet sites can control what you charge for commissioning custom items/pets/art that use the site's IP, or whether or not you can cross-trade things with other pet sites).
So the word you might be looking for is "fairly," and as someone who did have a Teo taken away yesterday, personally imo they handled this as fairly as possible. It didn't feel like a punishment to me because I already knew keeping the Teo wasn't fair either since many people who were told it was claimable the day after didn't even have the chance at it. I know other people might not agree with me and that's valid too but it was a mistake and they did the best they could to fix it. And maybe they could have done something different instead but (again imo) I think in the long run this was one of the better solutions.
But also if you weren't personally affected please don't assign feelings to the people who were, because generalizing people or making assumptions isn't fair either.

I've seen aywas make too many of these types of mistakes to trust putting money on here. I really am surprised you guys who actually were able to get something aren't more upset. I would be.

I'd love to see what law you're talking about because it happens all the time in retail (things like best buy who priced an item at $21 dollars rather than 121) and they absolutely were able to cancel the orders, stop the items from shipping.
Digital goods are the same as physical, so I see no legal issue with an error being corrected.
TOS even covers errors being able to be fixed like this.
As a user, I see this move as user friendly, because the site announced a set time, and is sticking to that set time so users who were in bed, because of the expected release date being sat, not Fri, don't lose out because someone who's a night owl jumped on a glitch/error.
Tosing out "not legal" is a big claim to make and if it has any legal law or case to cite, I'm sure staff would love to see it.
