Rules

Okay guys, it's time for another reminder about the copyright rules on Aywas.

For those of you who don't know, there is a copyright board found here.

You must create a thread on this board if you create a design that is based on something that is not your original design. This means if you reference anything that you don't own, you submit it here before you make it. If the copyright has expired on whatever it is you have based your design on, it must be submitted to the board so my team can just check.

It's always been a rule that if something is instantly recognisable as what it was based on, it is against the rules. People seem to have forgotten this little fact, so here's a reminder on that.

I've heard things said like, "Disney isn't going to sue a pet site." Disney will do this, and they have in the past. This is not an excuse, and by saying this and avoiding the copyright panel, you are putting the site at risk. It is their copyright, not Aywas, which is why we have the rules in place to protect Aywas.

Remember - The use of making designs based of copyright designs is a privilege, not a right you are entitled to. If you break the copyright rules, you put the site at risk and will face a punishment, which may be a permanent ban.

If these copyright rules keep on being broken, there may be discussion of removing the privilege of letting you design things that are not based on your own original work. Please think about your actions in the future so you don't ruin this privilege for the people who do follow the rules.

I hate grumping at you about this, but it is needed.

I already did this because i actually read rules. :P but do you think maybe more effort could be made to look into these designs? I see loads that have been untouched for ages, because it seems no one is actually going in to check them over :C

There's actually no evidence of Disney ever suing a pet site. Or even fansites for that matter. Pets that are loosely based off of characters owned by an individual, not distributed by the pet site itself, is considered fanart. The most Aywas would receive is a takedown notice to remove the content.

This isn't saying you -SHOULD- have a Mickey Mouse custom, but there's no need to be so over-zealous and angry.

It is NOT fanart, because people don't make money off fanart - or they shouldn't. Whereas, aywas makes money off customs. That makes it ILLEGAL for us to accept any copyrighted character. Therefore, no copyrighted characters are allowed. The copyright board ensures that customs submitted don't violate anyone else's intellectual property and are sufficiently different to be original.

No offense but I recall making a design for someone based off of Frankenfurter (Rocky Horror). They posted on the design board about it's legality and she was told the clothing color should be changed and the hair too. So instead of a Black haired, black PVC wearing melo, it was a brunette with red clothes. Not even a week later I was surfing through and ended up coming across another Frankenfurter custom that had Black clothing, black hair, AND the expression to match. I'm just fine and dandy with the whole Copyright thing but it needs to be enforced all the way around. Just saying.

If you find a custom that violates copyright, its owner probably went around the copyright forum. Regardless, please report it so it can be dealt with appropriately.
